Clerk oversight irks judge

A defendant in Santa Rosa County Dependency Court reports the Clerk’s Office turned her away when she attempted to file a Domestic Violence Injunction she was required to file in a dependency case regarding the custody of her children.


Janice Kendrick says the Department of Children and Families requested she file the protection order to keep her children away from their step-father who has an outstanding warrant for beating her.


In Santa Rosa County Circuit Judge Marci Goodman’s courtroom on Thursday, Kendrick stated to Goodman her reason for failing to obtain the Domestic Violence Injunction, or DVI.


“I went to file it and they asked me for his [the offender] address. I told them I did not know where he was because he left after I called the law. They told me if I did not have an address for them, they couldn’t do anything for me. I told them I had to have this done for court and they said they were sorry, without an address they couldn’t help me,” said Kendrick.


Goodman asked the Department of Children and Families officials present if this was something they were aware of.


DCF officials reported to Goodman they had “several people say the same thing. At first we thought they were lying or making excuses, but when you hear the same thing from several different clients, you start to make the connection that something is wrong, here,” says the DCF official present in court on Thursday.


Kendrick says, “When someone risks losing their children because they are being turned away from doing something DCF says they have to do to keep their children, it shouldn’t be taken lightly.”


“I am doing everything I am supposed to do. I left my husband who was beating me, I called the police to report what he did, and now my kids are dependents of the court. It’s no good when I can’t do what the court asks me to because of bad rules,” she says.


Judge Goodman called employees from the clerk’s office into the courtroom on Thursday to ask them about the reports of being turned away.
“It is my understanding that the clerk’s office has refused victims the right to serve a DVI [Domestic Violence Injunction] on perpetrators if they don’t have a mailing address for the offender. Is this correct?”


The employees answered Goodman saying, “This is the policy of the clerk’s office and we have always been told that we can not issue a DVI without a serving address.”


To which Goodman replied, “I don’t know why that is a policy, the person who enacted this policy is not an attorney so this needs to be addressed.”


The Chief Deputy of Courts Adair Cotton said on Monday afternoon that this has happened for the last couple of months due to inaccurate direction from a former supervisor who is no longer with the clerk’s office.


“This misunderstanding was brought to my attention a couple of weeks ago. That policy [of not taking DVIs without an address for the offender] has never been the clerk’s policy. Our policy is that we will take all DVIs. We will never turn down a DVI. This issue has been corrected and it happened unbeknownst to Mary [Johnson] or myself,” says Cotton.


Jennifer Crews is the Family Law Supervisor and she stated this had happened over the period of about six to eight weeks over the last couple of months. “An offender can’t be served with the DVI if we don’t have an address for them, but we can complete the filing process of the DVI.
Kendrick says she is happy Goodman addressed the problem.


“What if I had lost my kids over this? How would that be fair? I am glad the judge was fair and tried to make sure everybody did their job,” says Kendrick.

What is the point in posting your opinion, whether it is negative or not, it is still your opinion and you should be entitled to it, if someone keeps deleting it? When you work for the public there are going to be some who do not like you and disagree with you. Get used to it. Deleting comments is not going to solve the matter or change a person's mind. I guess the Clerk's office will delete anything deemed negative to them and with the out of sight out of mind type attitude, they pretend it was never there. Kind of like the way the Chief Deputy handles the employees. If there is a problem, blame someone who it not there to defend themselves and never, never take responsibility. Maybe the public will not notice and we will just pretend it never happened. Go ahead, delete my third comment if you can't handle the truth.

Now that the rules are clear to all, I am going to make my third attempt to post my opinion. I posted Sunday, made my second attempt last night, only to find last night's post had also been deleted. Had I been rude or called the other poster's names, I would understand. I suppose my posts strike a nerve with some of the negative posters because I believe in our county, I believe in Mrs. Johnson and I believe in her Chief Deputy. Apparently the posters on this site don't want to hear any of that. Mrs. Johnson and Mrs. Cotton do not deserve to be dragged through the mud over a misunderstanding in one office. It is apparent to many who have been watching this unfold that this week long rant is nothing more than an emotionally driven personal attack on someone who, in my opinion, must being doing something right. What I mean is, I think "thou dost protest too much". I believe it is time for us to agree to disagree. If you are that unhappy with our county, maybe it's time to find somewhere more to your liking to live where no one makes mistakes, no one does something you disagree with and everyone thinks just like you do. If you have never lived anywhere else, I can tell you from experience, Santa Rosa County is one of the best places in this entire country to live and raise a family.

Howdy folks. I am not here to defend anyone, but I want to remind all of you of the guidelines. There is no flaming and you are asked not to be hostile. In the same light if you comment you open yourself up to rebuttle. In the same light respect other people's opinions and let their comments be seen. Did some of you fail to read the instructions for posting comments before you started with your judgements? I served in a supervisory capacity for a number of years and you train a person that can competently serve in a position. Unfortunately, you can't stand over them 24/7 and make sure they are completing every aspect of their position letter perfect. You can however find an error, address and correct the problem and move on. Maybe some of the persons commenting need to do the same thing!

I believe all these comments about what goes on at the courthouse should be looked into. Why not interview the workers in secret so they call tell the public. It should be done in private because they, the workers, would be harrassed or even fired. Check out all the rumors. Find out what we really have for a Chief Deputy. I bet you would be shocked.

A lot of people keep reminding us that the supervisor who is no longer there should be the one held accountable for the problems. Let me ask you, who made that supervisor the supervisor? Anyone willing to bet it was the Chief Deputy? We could blame Mary Johnson but everyone knows she doesn't do much with the clerks. The Chief Deputy does. Place blame when it should be placed. Do we want this Chief Deputy to be our next Clerk of Courts? I say NO WAY! Get rid of her.

As other people have posted "negative" comments, I too believe the Chief Deputy should be held responsible. It is her job to supervise the supervisors. If she can't handle the job, get someone in there who can. Maybe that new someone would be promoted for skills and knowledge and not who they know, what judges they kiss up to or who they sleep with. Some clerk's office employees welcome the eye opener and hopes beyond hope that something will be done about the Chief Deputy. I wonder how long it will take for this comment to be removed? Too honest and negative I guess.

Maybe the negative comments were removed because some people weren't paying attention to the rule that says no insults. Besides anyine can remove comments. In case you didn't notice, there is a button under every comment that says Remove Comment. Or maybe you were too blind to see that.
